All new products sold under the authorized use of the name WaterSafelectronics or through Waterproof Electronics's online store include limited warranty coverage and return policies.

Product Return Policies:

There is a 30 Day Return Period on all products purchased. The return period starts once the product is delivered and ends 30 days after. The purchaser is responsible for the cost of the return shipping regardless of the matter for return. All returns must be shipped to one of the below addresses.

If unable to ship to the above address or would like to us another carrier UPS or FedEx, customers may ship directly to the below address. Before taking such action, customer must notify Waterproof Electronics, Inc. Failure to notify Waterproof Electronics, Inc. prior to shipping to the alternative address that may result in any lost, stolen or damaged products may not be covered under Waterproof Electronics, Inc. warranties or return policies.

Shipping:

Customers may use USPS, UPS, or FedEx when shipping to us (USPS is recommended). We ship all products USPS to domestic and international locations. For purchases, expect 5-10 business days for process and 2-5 days business days after we ship your order. For repairs and replacements expect 2-3 weeks processing time and 2-5 business days after we ship your product back to you.

Refund Policy:

Please contact us watersafelectronics@gmail.com prior to returning your product. If returning for repairs/replacement please include a note stating the issue with your purchase. To receive a refund, all purchase components must be return with a date of postage before or on the end return period date. After we receive your return it will be inspected for damages which may non-in-void a full and even a partial refund under its warranty. After we inspect your return you will be issued a refund. If there is a problem with your return we will contact you via mail, phone, or email stating such issue. Thank you for your adherence to our 30 day Return Policies.

TO RETURN YOUR WATERPROOF MP3 PLAYER FOR REPAIR SERVICE, YOU MUST FIRST CONTACT US BY EMAIL AT Watersafelectronics@gmail.com TO RECEIVE A LETTER OF AUTHORIZATION AND RETURN ADDRESS FROM US. After authorization from us, return the headset, with the copy of your invoice or receipt, full insured (for your protection) and packed well in original packaging, if possible. All shipping, duty, handling and/or restocking charges for returns and/or replacements shall be non-refundable and are the responsibility of the customer. Your headset will be returned to you by UPS Ground or by regular U.S. Mail.

Your waterproof iPod Shuffle must fall under the Swimman Warranty provided below in order for Waterproof Electronics to give you a full refund.

SWIMMAN SHUFFLE & SWIMMAN HEADSET WARRANTY

Waterproof Electronics, Inc. warrants this product against defects in materials and workmanship to the original purchaser only as specified below,

1. PARTS - If the product is determined to have a manufacturing defect, within a period of one (1) year from date of original purchase, Waterproof Electronics will repair or replace the product parts at no charge to you, excluding earbuds. For the first ninety (90) days of original purchase, the labor charge of repairing or replacing parts will be at no charge to you. After ninety (90) days of original purchase, the labor charge for servicing your product will be at your expense.

2. EARBUDS - The earbuds are warranted for any manufacturing defect, within a period of the first ninety (90) days of original purchase.

3. LABOR - Additionally, within a period of ninety (90) days from date of original purchase, Waterproof Electronics, at its own discretion, will service your product by repair or replacement at no charge to you. After ninety (90) days, all labor charges will be at your expense.

To obtain warranty service by an authorized Waterproof Electronics service center, you must drop off or mail the product to the authorized Waterproof Electronics service center in its original product packaging materials or equivalent, to prevent damage when in transit.

Further, should Waterproof Electronics determine that the product is outside of the warranty term, Waterproof Electronics will return the product to the sender at sender's expense, without being repaired or replaced, unless authorized by you to service the out-of-warranty product at your expense. All handling, duty or restocking charges for returns and/or replacements shall be non-refundable and are the responsibility of the customer.

Normal "wear and tear" is not covered by this warranty. Further, Waterproof Electronics hereby reserves the right to determine "wear and tear" on any and all products. Tampering or opening the product casing or wiring, will immediately void this warranty in its entirety.

Also this warranty does not apply if the product has been damaged by accident, abuse, misuse or misapplication; If any portion of the product, including the headset and earbuds have been altered or modified without the written permission of Waterproof Electronics, has been service by a non-authorized service repair center of Waterproof Electronics, has not been properly maintained or operated to the instruction manual; has been used for commercial, non-household purposes; cosmetically damaged; was not imported by Waterproof Electronics; was not manufactured according to specifications of the United States market; improper installation or neglect; damage due to improper packaging and shipment; damage due to natural disasters; or for cosmetic damages.

ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO ONE (1) YEAR PARTS AND NINETY (90) DAYS LABOR FROM THE DATE OF THE ORIGINAL RETAIL PURCHASE OF THIS PRODUCT.

THESE WARRANTIES AND REMEDIES ARE THE SOLE AND EXCLUSIVE WARRANTIES AND REMEDIES IN CONNECTION WITH THE SALE AND USE OF THE PRODUCT. NO OTHER WARRANTIES, ORAL OR WRITTEN, EXPRESSED OR IMPLIED, ARE GIVEN.

WATERPROOF ELECTRONICS IS NOT RESPONSIBLE OR LIABLE FOR ANY DAMAGE, WHETHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, DIRECT OR OTHERWISE, AND WHETHER KNOWN OR SHOULD HAVE BEEN KNOWN TO WATERPROOF ELECTRONICS, INCLUDING LOST PROFITS, GOODWILL, AND PROPERTY AND PERSONAL INJURY RESULTING FROM ANY BREACH OF WARRANTY, THE INABILITY TO USE THE PRODUCT OR UNDER ANY LEGAL THEORY IN CONTRACT OR TORT. WATERPROOF ELECTRONICS SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGE TO OR LOSS OF USE TO ANY AUDIO DEVICE FROM USE OF THIS PRODUCT WITH SUCH DEVICES (SOME WATERPROOF ELECTRONICS LIABILITY IS LIMITED TO THE ACTUAL PURCHASE PRICE PAID TO THE ORIGINAL PURCHASER OR RESELLER OF THE DEFECTIVE PRODUCT.

No Waterproof Electronics dealer, agent or employee is authorized to make any modification, extension, change or amendment to this warranty without the written consent and authorization from Waterproof Electronics.

Some states do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, or do not allow a limitation on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

Proof of purchase in the form of a bill of sale or receipt is required as evidence that the product is within the warranty period and must be presented to obtain warranty service

Warranty Period encompasses, as listed below, separate "Coverage Periods" for Parts and Labor, each Coverage Period to begin from the original date of Customer purchase. If Customer returns a defective Product (or any component thereof) during the applicable Warranty Period, Waterproof Electronics will, at its option, during the specified Coverage Periods for Parts and Labor (as applicable} either: (i) repair the Product (or, as applicable, any component thereof) or (ii) replace the Product {or, as applicable, an;' component thereof) with a new or refurbished Product (or, as applicable, any component thereof), in either case free of charge to Customer for Parts and/or Labor (as applicable) during the specified Coverage Period only, and excluding applicable shipping charges {noted below), for which the Customer is responsible. The foregoing states the Customer's exclusive remedy and Waterproof Electronics’s sole liability for breach of the limited warranty contained herein.
This Warranty specifically excludes any Product (or, as applicable, any component thereof) that has been subject to or Defects resulting from: (a) any neglect or misuse by a Customer, an accident, improper application, violation of operating instructions for the Product, any other Customer-induced damage, or the alteration or removal of any Product serial number; {b) any modification or repair to Product {or, as applicable, any component thereof) by any party other than Waterproof Electronics or a party authorized in writing by Waterproof Electronics; (c) any damage to Product (or, as applicable, any component thereof) due to power surges, incorrect electrical voltage, misconnection to any device, or malfunction of any device used with the Product (or, as applicable, any component thereof); (d) cosmetic damage to the Product (or, as applicable, any component thereof) caused by normal wear and tear; (e) shipping damage that occurs while the Product is in transit; (f) damage caused by heat sources, sunlight, electromagnetic conditions, or other climatic conditions other than water; or (g) any acts of God.

Product is sold to Customer for personal, non-commercial use only. Product is no t warranted for Customer's commercial or rental use. In addition, Product is not warranted against failure, and should not be used by Customer for any application where (i) there is a risk that any data stored on the product will be breached or otherwise compromised, or (ii) the data stored on Product is relied upon for medical or lifesaving applications. Waterproof Electronics disclaims any Warranty for any of the foregoing uses to the fullest extent permitted by law. Customer assumes any and all risks associated with such uses of Product, and agrees to indemnify Waterproof Electronics for any damages claimed against Waterproof Electronics for such uses.

EXCEPT FOR EXPRESS WARRANTIES STATED ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRODUCTS ARE PROVIDED "AS IS", AND WATERPROOF ELECTRONICSDISCLAIMS ALL OTHER WRRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY (I) OF MERCHANTABILITY, (II) OF FITNESS FOR A PARTICULAR PURPOSE, OR (III) OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WATERPROOF ELECTRONICS BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS OR REVENUES, LOSS OR INACCURACY OF ANY DATA OR COST OF SUBSTITUTE GOODS, REGARDLESS OF THE THEORY OF LIABILITY (INCLUDING NEGLIGENCE) AND EVEN IF WATERPROOF ELECTRONICS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WATERPROOF ELECTRONICS'S AGGREGATE LIABILITY TO CUSTOMER FOR ACTUAL DIRECT DAMAGES FOR ANY CAUSE WHATSOEVER SHALL BE LIMITED TO THE CUMULATIVE PRODUCT FEES PAID BY THAT CUSTOMER FOR THE PRODUCT CAUSING THE DAMAGES, IF ANY.

This Warranty gives Customer specific rights, and Customer may also have other rights that vary from jurisdiction to jurisdiction.

A New Warranty Does Not Start With The Replacement Of A New Product.
If you have problems with the replacement, please contact us immediately! Our warranty does not cover any product that has been subject to neglect, unreasonable use, accident, violation of the operating instructions, or any product that has been modified by you or an unauthorized service agent. Products out of warranty requiring replacement will be reviewed individually, but all will require the $8 shipping and handling fee. Please send a note stating issue with your return.
